Fiancé(e) Visa / K-1 Visa

A K-1 fiancé visa is a temporary visa that U.S. Citizenship and Immigration Services (USCIS) reserves for the future spouses of U.S. citizens. The K-1 visa is a single use visa that allows your foreign fiancé to enter the country in order to get married. After your foreign fiancé receives their visa and enters the United States, you must marry within 90 days. After you get married, you can apply for a green card (become a permanent resident) in the U.S., through a process called adjustment of status. When you get a K-1 visa, any of your unmarried children under the age of 21 can be issued K-2 visas. This will enable them to accompany you to the U.S.

We often get asked which visa is faster, spousal visa or fiancé visa? While both processes are similar, the benefit of a fiancé visa is that generally your foreign fiancé can join you in the U.S much faster than with a spousal visa.

Eligibility For K-1

  • Both you and your fiancé must be single and eligible to be married under U.S. law.
  • The sponsoring partner must be a U.S. citizen.
  • You must have met in person at least once in the past two years. This requirement can be waived for religious practices or in cases of extreme hardship to the U.S. citizen partner.
  • The U.S. citizen partner must meet certain income requirements, earning at least 100% of the federal poverty guidelines when applying for the fiancé visa, and earning 125% of these guidelines when the foreign partner applies for his or her green card (adjustment of status).

The K-1 fiancé visa is the best choice for engaged couples if one or more of the following is true:

  • You want to be together in the United States as soon as possible—typically several months for a fiancé instead of over a year for a spousal visa

Adjusting Status after the K1 Fiancé Visa – Don't Delay

Once your fiancé enters the U.S on a K1 Fiancé Visa, you have 90 days to get married. DO NOT OVERSTAY ON THIS VISA- GET MARRIED RIGHT AWAY! After getting married on the K1 Fiancé Visa, you must apply to adjust status. If you do not get married as planned within those 90 days, the foreign fiancé must leave the United States before the 90 days expires. If the foreign fiancé overstays past 90 days, there will be some form of consequences.
